The GlobalCBD.com website (the “Site”) is comprised of various web pages operated by Global CBD INC and is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of GlobalCBD.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference. GlobalCBD.com is an E-commerce Site that provides high quality CBD products including but not limited to tinctures, liquids, and various skin care products.
SEVERABILITY; INTERPRETATION
If any provision of this Agreement is deemed illegal or unenforceable, the remainder of this Agreement shall continue to be fully valid, binding, and enforceable. When used in this Agreement, the term “including” shall be deemed to be followed by the words “without limitation.”
PRIVACY POLICY
Before you continue using our website we advise you to read our privacy policy. See Privacy Policy regarding our user data collection. It will help you better understand our practices.
RETURN POLICY
If you are not 100% satisfied with your retail purchase, you can return the product and receive a full refund or exchange the product for another one, be it similar or not. You can return a product for up to 30 days from the date you purchased it. Any product you return must be in the original packaging. Please keep the confirmation email as it is required to make a return.
SHIPPING POLICY
Upon placing an order, we process them in the order they are received. Our goal is to ship all orders that are received by 2:00pm PST M-F business days on the same day (excluding holidays and unforeseen circumstances). This includes any shipments that are drop shipped by our various vendors. This policy may be delayed during peak shopping times and could delay your order 1-4 business days from being shipped. If the order is on back order there will be a delay in your purchase, and you will be contacted by a customer service representative if your item becomes no longer available and an immediate refund or exchanged will be given.
All orders are shipped via USPS First Class or Priority Mail services, and tracking (if available) is provided by default via e-mail. Global CBD INC is not responsible for events outside of our control such as packages damaged, lost, tampered with, rifled through or misdirected by USPS or stolen by a third party after delivery.
PROHIBITED
By agreeing to the terms of conditions herein, the purchaser of products from GlobalCBD.com agrees as follows:
All products purchased are for personal consumption only, and may not be used for any other prohibited purpose without the express written consent of Global CBD INC. Prohibited purposes shall include without limitation: purchase or use by individuals under 18 years of age, purchase for resale of products to wholesalers or retail customers; purchase for testing, screening, or analysis, for the purpose of reverse engineering or acquisition of Global CBD INC’s proprietary information; purchase for the purpose of evaluating, offering or terminating credit or merchant processing services that are being provided to Global CBD INC by purchaser, its client, employee, or associate.
Purchaser expressly agrees that violation of this policy will cause Global CBD INC to incur costs and expenses not contemplated under the terms of purchaser’s transaction. Those include without limitation bank fees, finance charges, attorney fees, accounting expenses, administrative costs, and lost revenue. Therefore Purchaser agrees to pay Global CBD INC liquidated damages in the amount of $100,000 per occurrence for any violation of the use policy. Purchaser and Global CBD INC agree that this represents a reasonable estimate of costs and expenses incurred by Global CBD INC from Purchaser’s violation of the use policy, and is fair compensation to Global CBD INC for its losses caused by Purchaser’s violation of the use policy. Acceptance of liquidated damages shall not constitute a waiver of Purchaser’s default with respect to such nonpayment by Purchaser nor prevent Global CBD INC from exercising any other rights and remedies available by law.
NO UNLAWFUL OR PROHIBITED USE/INTELLECTUAL PROPERTY
You are granted a non-exclusive, non-transferable, revocable license to access and use GlobalCBD.com strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to Global CBD INC that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site. Copyright Content published on this website (digital downloads, images, texts, graphics, logos) is the property of Global CBD INC and/or its content creators and protected by international copyright laws. The entire compilation of the content found on this website is the exclusive property of Global CBD INC, with copyright authorship for this compilation by Global CBD INC. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto. You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. ADHERANCE
The failure of Global CBD INC Parties to insist upon strict adherence to any term of this Agreement shall not constitute a waiver of such term and shall not be considered a waiver or limit that party’s right thereafter to insist upon strict adherence to that term or any other term of this Agreement.
LINKS TO THIRD PARTY SITES/THIRD PARTY SERVICES
GlobalCBD.com may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of Global CBD INC and Global CBD INC is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Global CBD INC is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Global CBD INC of the site or any association with its operators.
Certain services made available via GlobalCBD.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the GlobalCBD.com domain, you hereby acknowledge and consent that Global CBD INC may share such information and data with any third party with whom Global CBD INC has a contractual relationship to provide the requested product, service or functionality on behalf of GlobalCBD.com users and customers.

Content has to be free of software viruses, political campaign, and commercial solicitation. We reserve all rights (but not the obligation) to remove and/or edit such content. When you post your content, you grant Global CBD INC non-exclusive, royalty free and irrevocable right to use, reproduce, publish, modify such content throughout the world in any media.

Global CBD INC reserves the right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat any photography or video taken by Global CBD INC, its officers, directors, employees, agents, any related DBA, LLC, S Corp, C Corp, or any other business entity under the Global CBD INC umbrella at any Event hosted or sponsored by Global CBD INC.
APPLICABLE LAW/JURISDICTION/DISPUTE RESOLUTION
This Agreement shall be governed by and construed in accordance with the Federal Arbitration Act, applicable federal laws, and the laws of the State of Idaho in the United States, without regard to its choice of law provisions. Any dispute or claim relating in any way to your use of the Site, or to any products or services sold or distributed by Global CBD INC or through the Site will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. You understand and agree that you are waiving your right to sue or go to court to assert or defend your rights under this contract. The Federal Arbitration Act and federal arbitration law apply to this Agreement. There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Terms of Use as a court would. To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our agent for service of process. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA’s Supplementary Procedures for Consumer Related Disputes. The AAA’s rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.
INDEMNIFICATION
You agree to indemnify, defend and hold harmless Global CBD INC, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys’ fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Global CBD INC reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Global CBD INC in asserting any available defenses.
INTERNATIONAL USERS
The Service is controlled, operated and administered by Global CBD INC from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Global CBD INC Content accessed through GlobalCBD.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
USER ACCOUNT
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Global CBD INC is not responsible for third party access to your account that results from theft or misappropriation of your account. Global CBD INC and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.
THIRD PARTY ACCOUNTS
You will be able to connect your Global CBD INC account to third party accounts. By connecting your Global CBD INC account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.
TERMINATION/ACCESS RESTRICTION
Global CBD INC reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Idaho and you hereby consent to the exclusive jurisdiction and venue of courts in Idaho in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Global CBD INC as a result of this agreement or use of the Site. Global CBD INC’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Global CBD INC’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Global CBD INC with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Global CBD INC with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Global CBD INC with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. GLOBAL CBD INC AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME. GLOBAL CBD INC AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND. GLOBAL CBD INC AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON INFRINGEMENT. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
